Website Terms of Use

These Terms of Use govern your access to and use of discoverynest.net (the “Site”), operated by Discovery Nest Early Learning Center, a licensed child care centre in Edmonton, Alberta. By using the Site, you agree to these terms.

1. The Site is informational

The Site describes our programs, our educators, and our approach to early learning. It is provided in good faith, but nothing on it is a binding offer, a guarantee of a space in any program, or professional advice for your family’s particular situation. Details can change, and pages may occasionally be out of date.

2. Enrollment is arranged with the centre

Care at Discovery Nest is arranged directly with us and set out in the enrollment paperwork you sign with the centre — not through this website. Submitting the contact form or joining the waitlist does not enroll a child, reserve a space, or create a care arrangement. We will contact you about availability, and any placement is confirmed in writing with the centre.

3. Waitlist registration

Our registration form is hosted by TimeSavr, a separate service. When you open it from our waitlist page you leave this Site, and that service’s own terms apply to the form you complete there.

4. Intellectual property

The Site and its contents — text, photographs, graphics, the Discovery Nest name and logo, page designs, and code — belong to Discovery Nest Early Learning Center and are protected by copyright and trademark law. You are welcome to view the Site and share links to it. Please do not copy, reproduce, or republish substantial portions of its content or design without our written permission. The photographs on this Site show our classrooms and the children in our care, and may not be reused.

5. Acceptable use

You agree not to attempt to breach, probe, or disrupt the Site’s security; scrape or harvest content at abusive volumes; submit our forms under a false identity for deceptive purposes; or use the Site for any unlawful purpose.

6. Third-party links

The Site links to third-party websites and services, including our registration provider, our social media pages, and product links in our registry guides. Some of those product links are Amazon affiliate links, which means the Nest may earn a small commission at no extra cost to you. We do not control and are not responsible for third-party sites or their terms.

7. Disclaimer and limitation of liability

The Site is provided “as is” and “as available,” without warranties of any kind regarding the Site itself, to the extent permitted by law. To the extent permitted by applicable law, Discovery Nest is not liable for indirect, incidental, or consequential damages arising from your use of the Site. Nothing in these terms limits rights that cannot be limited under applicable law, including rights under Alberta consumer protection legislation, and nothing here affects the obligations we owe to enrolled families under our enrollment agreements or under Alberta child care licensing requirements.

8. Privacy

Your use of the Site is also subject to our Privacy Policy, which describes the limited information we collect and how we handle it.

9. Changes

We may update these Terms of Use from time to time. The effective date above reflects the latest version, and continued use of the Site after a change means you accept it.

10. Governing law

These Terms of Use are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes relating to the Site are subject to the exclusive jurisdiction of the courts of Alberta.
